Summary

In October 2019, an adult victim interviewed by the FBI/SDNY alleges that Jes Staley raped her in Epstein’s New York residence after Epstein directed her to him for a massage. According to her testimony, when she attempted to provide a normal massage, Staley forced her to touch his genitals and raped her. When she complained to Epstein, he responded that he ‘left it to her and Staley to decide if they wanted to have sexual relations.’ The victim was not paid. Critical anomaly: the Manhattan DA opened an investigation into Leon Black (referenced in the same testimony) but no prosecution is known to have been initiated against Staley.

Detailed description

The Testimony (EFTA00174356-page5)

The document is a Case Initiation Summary FBI/SDNY. In October 2019, an ADULT victim was interviewed by the FBI and the SDNY. Their testimony contains several factual elements:

  1. Direction by Epstein: Epstein directed the victim to two individuals named — Leon Black and Jes Staley — for massages.
  2. Alleged Rape: When the victim attempted to provide a normal massage to Staley in Epstein’s New York residence, 'Staley forced her to touch his genitals and raped her'.
  3. Epstein’s Reaction: When the victim complained to Epstein, he responded: 'he said he left it to her and Staley to decide whether to engage in sex'. This formulation is noteworthy — Epstein does not condemn, does not apologize, and reframes rape as a 'mutual decision'.
  4. Lack of Payment: 'The victim was not paid for either instance' — which distinguishes this case from the usual pattern where victims were paid for massages.

Context within the Document (page 4)

The FBI explicitly notes: 'No other victim described being directed by either Epstein or Maxwell to engage in sexual activity with any other men' — this sentence appears BEFORE the October 2019 revelations. This victim’s testimony is therefore the FIRST to establish a direction to third parties named for sexual acts.

This status of unique testimony is both a strength (precise allegation with details) and a weakness (lack of independent corroboration).

The Anomaly of Non-Prosecution

The same document EFTA00174356 mentions Black and Staley in the same circumstances (direction by Epstein, massage, abuse). However:

  • Leon Black: The Manhattan DA (Cy Vance then Alvin Bragg) opened an investigation. Although Black was not indicted, the investigation existed and was publicly documented.
  • Jes Staley: NO known investigation by the Manhattan DA. NO prosecution. The allegation of rape — more serious than what is reported for Black — does not appear to have generated comparable legal action.

Several hypotheses may explain this asymmetry:

  • (A) The victim refused to testify formally against Staley but did against Black.
  • (B) The evidentiary elements were insufficient specifically for Staley.
  • (C) The British jurisdiction of Staley (CEO Barclays, based in London) complicated prosecutions.
  • (D) A selective prosecution strategy motivated by unpublished considerations.
  • (E) The ongoing British FCA inquiry (2020-2021) was considered sufficient.

None of these hypotheses is documented. The anomaly remains open.

Distinction with THEORY-1063 and THEORY-1176

  • THEORY-1063 covers the FINANCIAL/REGULATORY aspect of Staley: JPMorgan relationship, 50+ emails, FCA inquiry, Barclays resignation. ZERO mention of sexual abuse allegations.
  • THEORY-1176 covers the allegation of directing victims to Black AND Staley jointly — focused on the verb 'directing' and the legal qualification of trafficking. It does not detail the alleged rape or the anomaly of non-prosecution specific to Staley.
  • THEORY-1179 (the present document) is dedicated specifically to: (1) the alleged rape by Staley, (2) Epstein’s reaction, (3) the anomaly of selective non-prosecution.

The Staley Profile — Corroborating Elements from the Corpus

Without constituting direct proof of the rape allegation, the following elements from the corpus document a deep and prolonged proximity between Staley and Epstein that renders the testimony contextually coherent:

  • Proffer Maxwell: Staley is cited as a current client ('is', not 'was') — the 2nd name after Wexner.
  • 50+ emails discovery JPMorgan v. USVI 2023.
  • Visit Little St. James 2015 (7 years after the 2008 conviction).
  • Recipient circle March 2011 (article Ward, THEORY-1173).
  • Successor executor of Epstein’s will — extremely high level of trust.
  • Stern-Staley Triangle (EFTA00903199): Staley wrote to Stern via Epstein 'How did it go with the Morgan crowd?'
  • Fang Fang Triangle (EFTA00906402): Fang Fang as a node between Staley and Stern.
  • FCA inquiry: Staley resigned from Barclays in November 2021 for concealing his links with Epstein.
  • 'Wager' Memo (article Ward March 2011): potentially transactional dimension with Epstein.
